This report identifies and analyzes the persistent ICWA violations by the state’s Department of Social Services encountered by all tribes in South Dakota. Drawing from the success of Washington state’s Port Gamble S’Klallam Tribe, this report examines the structural solution to the illegal taking of Lakota children: the establishment and maintenance of a tribal-run child and family services program (IV-E). Our work concludes that the implementation of this solution could end the slow cultural genocide of the Lakota people.
